Datura alkaloids<\/strong> are regulated in the EU<\/strong> under Regulation (EU) No 2016\/239 amending Regulation (EC) No 1881\/2006, only for cereal-based preparations and foods for infants and young children containing millet, sorghum, buckwheat or products derived thereof, at levels of 1 \u00b5g\/kg of atropine<\/strong> and 1 \u00b5g\/kg of scopolamine<\/strong>.<\/p>\n

A draft regulation<\/strong><\/a> is in progress, with the proposed changes involving the addition of limits for the following raw materials: millet, sorghum, buckwheat and their milling products, and maize milling products, maize grains, infusions in solid or liquid form.<\/p>\n

In 2009, Anses published an opinion<\/a> setting an intervention threshold of 100 \u00b5g of total alkaloids<\/strong> (sum of atropine and scopolamine) per kilogram of buckwheat flour<\/strong>.<\/p>\n

Since the publication of this opinion, knowledge of the acute toxicity of these contaminants has evolved.<\/p>\n

In a 2013 opinion<\/a>, EFSA set an acute reference dose (ARfD) of 0.016 \u00b5g\/kg body weight<\/strong>.<\/p>\n

On 8 February 2019, ANSES was requested by the DGCCRF to provide scientific and technical support<\/a> to update its opinion of 18 February 2009.<\/p>\n

The agency’s conclusions reveal that the intervention threshold of 100 \u00b5g\/kg of buckwheat flour is not protective enough to ensure that buckwheat flour consumers’ exposure remains below the ARfD, and must therefore be considered obsolete. Pending the entry into force of regulatory maximum levels to be set at EU level, a new intervention threshold of 16 \u00b5g\/kg<\/strong> of datura alkaloids<\/strong> should be applied for buckwheat flour sold in France.<\/p>\n
