Regulation (EU) 2018\/848<\/strong> of 30 May 2018 on organic production and labelling of organic products was published on 14 June 2018. Below is a summary of the new features introduced by this regulation:<\/p>\n – Hydroponic production, which consists of placing the roots of certain plants in a nutrient solution, is prohibited.
\nThis new regulation repeals Regulation 834\/2007 and will be applicable<\/strong> from 1 January 2021<\/strong>.<\/p>\n
\n– The production of processed organic food excludes food containing or consisting of manufactured nanomaterials.
\n– Certain products have been included within the scope of the regulation as they can be produced using natural production techniques. These products are listed in Annex I of the regulation.
\n– A group certification system for small farmers and operators has been introduced to reduce inspection and certification costs and administrative burdens, strengthen local networks, help develop better market outlets and ensure fair conditions of competition compared with operators in third countries.
\n– A holding may carry out organic, in-conversion and non-organic production at the same time under certain conditions.
\n– Operators and groups of operators are subject to a compliance check at least once a year. Where no non-compliance has been found for 3 consecutive years, the interval between two on-site physical inspections will be two years.
\n– By 31 December 2024 at the latest, the Commission will present a report to the European Parliament and the Council on the presence of products and substances whose use is not authorised in organic production and on the evaluation of existing national rules. This report may be accompanied by a legislative proposal providing for further harmonisation.
\nAt present, Member States with national rules prohibiting the marketing as organic of products whose content of an unauthorised substance exceeds a certain level may continue to apply these rules, provided that they do not prohibit, restrict or prevent the placing on the market as organic of products obtained in other Member States, where those products have been obtained in accordance with this regulation. Member States applying such rules must inform the Commission as soon as possible.
\n– In the event of contamination by an unauthorised substance, if the control body establishes that it resulted from deliberate use or that precautionary measures were not applied, the product concerned may not be marketed as an organic or in-conversion product, nor used in organic production.<\/p>\n
