<\/p>\n\n

Regulation (EU) No 2022\/1393<\/a>, amending Regulation (EC) No 1881\/2006, was published on 12 August 2022 in the Official Journal of the European Union.<\/p>\n\n

THC, more specifically \u03949-THC, is the main constituent of hemp (Cannabis sativa<\/em>).<\/p>\n\n

In 2016, Commission Recommendation (EU) 2016\/2115 was adopted to obtain further data on the presence of \u03949-THC and other relevant non-psychoactive precursors in hemp-derived foodstuffs and in foodstuffs containing hemp or hemp-derived ingredients.<\/p>\n\n

In January 2020, EFSA published a scientific report assessing acute human exposure to \u03949-THC, taking into account data collected under Recommendation (EU) 2016\/2115. The ARfD of 1 \u03bcg\/kg bw was exceeded in some estimates of acute exposure, meaning \u03949-THC could pose a health concern.<\/p>\n\n

This new text introduces maximum levels for the sum of delta-9-tetrahydrocannabinol (\u03949-THC) and delta-9-tetrahydrocannabinolic acid (\u03949-THCA) in hempseed and its derived products.<\/p>\n\n

\u03949-THCA must also be tested for, as it can be converted into \u03949-THC during processing.<\/p>\n\n

Foodstuffs legally placed on the market before 1 January 2023 may remain on the market until their minimum durability date or use-by date.<\/p>\n\n

The regulation applies from 1 January 2023.<\/p>\n\n
