{"id":544384,"date":"2026-08-27T01:00:34","date_gmt":"2026-08-26T23:00:34","guid":{"rendered":"https:\/\/dev.phytocontrol.com\/uncategorized\/new-food-alert-management-guide-2023\/"},"modified":"2026-08-27T01:00:34","modified_gmt":"2026-08-26T23:00:34","slug":"new-food-alert-management-guide-2023","status":"publish","type":"post","link":"https:\/\/dev.phytocontrol.com\/en\/regulatory-watch\/new-food-alert-management-guide-2023\/","title":{"rendered":"New Food Alert Management Guide 2023"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">The revised food alert management guide has just been officially published through Technical Instruction <a href=\"https:\/\/www.phytocontrol.com\/wp-content\/uploads\/2023\/02\/2023-11_final.pdf\">DGAL\/MUS\/2023-11<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">The guide was last revised in 2009, with an annex added in 2012.<\/p>\n\n<p class=\"wp-block-paragraph\">Since then, new hazards have emerged, analytical methods and regulations have evolved, and administrative structures have changed, making it necessary to update this guide.<\/p>\n\n<p class=\"wp-block-paragraph\">This guide applies to the management of alerts concerning food products intended for human consumption, but does not cover non-conformities of foodstuffs that are still under the operator&#8217;s control.<\/p>\n\n<p class=\"wp-block-paragraph\">Within the meaning of the guide, an alert corresponds to a foodstuff that:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Is considered dangerous or likely to be so<\/li>\n\n\n\n<li>Is no longer under the direct control of the operator that placed it on the market<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong><u>Case of pesticides<\/u><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">For each exceedance, the operator must carry out a risk analysis.<\/p>\n\n<p class=\"wp-block-paragraph\">Two cases:<\/p>\n\n<p class=\"wp-block-paragraph\">&#8211; The risk analysis concludes there is no risk: this is not an alert, and the non-conformity does not need to be notified to the authorities. However, withdrawal of the foodstuff is required but does not require informing consumers.<\/p>\n\n<p class=\"wp-block-paragraph\">&#8211; The risk analysis concludes there is a risk to the consumer (exceedance of toxicological threshold): this is an alert within the meaning of the guide, and management measures apply. A recall must be implemented along with consumer information.<\/p>\n\n<p class=\"wp-block-paragraph\">Specific rules for taking measurement uncertainty into account (or not) when declaring conformity have been established and are detailed in Annex VIII of the guide.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>Case of environmental contaminants:<\/u><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">For certain contaminants (cadmium, lead, dioxins, etc.), small exceedances of maximum levels do not necessarily constitute a danger, as these limits are set based on chronic toxicity. However, operators must by default consider that an exceedance constitutes a danger to the consumer.<\/p>\n\n<p class=\"wp-block-paragraph\">For contaminants, measurement uncertainty must be subtracted from the raw result to assess conformity, <strong>except for contaminants posing an acute toxic risk to the consumer<\/strong> (alkaloids, marine biotoxins, histamine, etc.).<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>Case of illegal treatments:<\/u><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">When prohibited or unauthorised substances are detected in food-producing animals, all products derived from the animals concerned are declared unfit for human consumption.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>Case of an unauthorised ingredient or one used outside authorisation conditions<\/u><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Additives, flavourings, GMOs, novel foods \u2013 all are subject to authorisation procedures.<\/p>\n\n<p class=\"wp-block-paragraph\">If a foodstuff is placed on the market without prior authorisation, it is considered dangerous. This situation requires corrective action and must be notified to the competent authority.<\/p>\n\n<p class=\"wp-block-paragraph\">When an authorised product has been used outside its authorisation conditions (exceeding an additive&#8217;s maximum level, etc.), the foodstuff is not necessarily harmful to health. In this case, operators must submit a risk analysis to the authorities.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>Alert notification<\/u><\/strong><\/p>\n\n<ol class=\"wp-block-list\">\n<li>The first operator who identifies or suspects a non-conformity must immediately inform the other operators concerned by the alert: direct supplier and direct customers<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Ideally, information should reach the entire chain of operators concerned within 48 hours.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Obligation to inform the authorities by submitting an electronic declaration using Cerfa form No. 16243*01 via the mesdemarches.agriculture.gouv.fr or service-public.fr websites, or by completing the downloadable Cerfa form and sending it by email to the local authority.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Note that if the foodstuff is still under the operator&#8217;s control, the operator must still notify the non-conformity to the authorities.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>Management measures<\/u><\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Withdrawal from the market when it is no longer under the operator&#8217;s direct control. The operator must not wait for authority validation and must proceed directly with the withdrawal.<\/li>\n\n\n\n<li>Consumer information when the foodstuff has reached consumers<\/li>\n\n\n\n<li>Recall when the product has been supplied to the consumer and the above measures are insufficient to ensure consumer safety. This must be notified on the &#8220;RappelConso&#8221; website.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These measures are implemented by the operator holding the non-conforming product throughout the product&#8217;s distribution chain, with each intermediary informing the next. Every operator at each stage must implement the first management measures within less than 24 hours of the notification date.<\/p>\n\n<p class=\"wp-block-paragraph\">Regarding certain microbiological parameters, in the absence of a regulatory safety criterion, Annex X Part 1 of the guide has set thresholds for Salmonella spp, e.coli STEC, Listeria monocytogenes, Campylobacter, Clostridium perfringens, Bacillus cereus, coagulase-positive staphylococci, staphylococcal enterotoxins, Vibrio, Shigella, botulinum toxin, and stability in canned products.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The principles of this guide have been enforced by the authorities since 10 January 2023, its publication date.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Food sector operators are expected to have incorporated its principles into their food safety plan by 31 December 2023.<\/strong><strong><\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Two instructions related to this guide have also been published:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">&#8211; Technical instruction <strong><a href=\"https:\/\/www.phytocontrol.com\/wp-content\/uploads\/2023\/02\/2023-14_final.pdf\">DGAL\/SDSSA\/2023-14<\/a><\/strong>: it describes the procedures for notifying the administrative authority by operators of health information concerning foodstuffs, animal feed or the production environment of these products under Article L.201-7 of the Rural and Maritime Fishing Code (repeals technical instruction DGAL\/SDSSA\/2019-555)<br\/>&#8211; Technical instruction <strong><a href=\"https:\/\/www.phytocontrol.com\/wp-content\/uploads\/2023\/02\/2023-27_final.pdf\">DGAL\/SDSSA\/2023-27<\/a><\/strong>, which specifies the regulatory requirements regarding the Listeria monocytogenes hazard applicable to the production and marketing of ready-to-eat foods of animal origin or containing animal products, except for canned products and live shellfish.<\/p>\n\n<p class=\"wp-block-paragraph\">Please note that your Phytocontrol laboratory offers pesticide residue analysis under COFRAC accreditation.
