{"id":544370,"date":"2026-08-27T01:00:14","date_gmt":"2026-08-26T23:00:14","guid":{"rendered":"https:\/\/dev.phytocontrol.com\/uncategorized\/ban-on-phosmet-in-fresh-cherries\/"},"modified":"2026-08-27T01:00:14","modified_gmt":"2026-08-26T23:00:14","slug":"ban-on-phosmet-in-fresh-cherries","status":"publish","type":"post","link":"https:\/\/dev.phytocontrol.com\/en\/regulatory-watch\/ban-on-phosmet-in-fresh-cherries\/","title":{"rendered":"Ban on phosmet in fresh cherries"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p><h3>Le statut r\u00e9glementaire du phosmet en UE<\/h3>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A32022R0094&amp;qid=1680010261194\"><strong>Implementing regulation (EU) 2022\/94<\/strong><\/a> did not renew the approval of phosmet as a plant protection substance.<\/p>\n\n<p class=\"wp-block-paragraph\">This substance has been <strong>banned in the EU<\/strong> since 01\/02\/2022.<\/p>\n\n<p class=\"wp-block-paragraph\">The grace periods for storage and use of stocks were set at <strong>01\/11\/2022<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">The EU MRL, set at 1 mg\/kg for cherries, has not yet been revised.<\/p>\n\n<p class=\"wp-block-paragraph\"><\/p><h3>L\u2019utilisation du phosmet hors UE<\/h3>\n\n<p class=\"wp-block-paragraph\">Although banned in the EU, the use of phosmet-based plant protection products is authorised for treating cherries in other countries:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>In Canada: only on sour\/tart cherries.<\/li>\n\n\n\n<li>In Chile: on sweet and sour\/tart cherries.<\/li>\n\n\n\n<li>In the United States: on sweet and sour\/tart cherries.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><\/p><h3>La position de la France<\/h3>\n\n<p class=\"wp-block-paragraph\">On 9 February 2023, France requested that the European Commission take emergency measures to suspend the import of fresh cherries from cherry trees treated with phosmet, the consumption of which is likely to pose a serious risk to human health.<\/p>\n\n<p class=\"wp-block-paragraph\">In the absence of any action taken by the European Commission, France has just published the <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047341155\">order of 16 March 2023<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">This text suspends the <strong>introduction, import and placing on the market<\/strong>, whether free of charge or for payment, in <strong>France<\/strong> of fresh <strong>cherries<\/strong> intended for food, produced in a country authorising the treatment of cherry trees with plant protection products containing the active substance <strong>phosmet<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Given that European rules on organic cherry production do not permit the use of plant protection products containing the active substance phosmet, cherries from organic production in compliance with regulation (EU) 2018\/848 may be introduced, imported or placed on the French market.<\/p>\n\n<p class=\"wp-block-paragraph\">According to Article 1, this suspension is valid for a <strong>period of one year<\/strong> from 26\/03\/2023, the date the order came into force.<\/p>\n\n<p class=\"wp-block-paragraph\">Please note that your Phytocontrol laboratory offers pesticide residue analysis under COFRAC accreditation.
