{"id":544281,"date":"2026-08-27T00:35:58","date_gmt":"2026-08-26T22:35:58","guid":{"rendered":"https:\/\/dev.phytocontrol.com\/uncategorized\/decree-no-2024-33-on-reused-water-in-the-food-industry\/"},"modified":"2026-08-27T00:35:58","modified_gmt":"2026-08-26T22:35:58","slug":"decree-no-2024-33-on-reused-water-in-the-food-industry","status":"publish","type":"post","link":"https:\/\/dev.phytocontrol.com\/en\/regulatory-watch\/decree-no-2024-33-on-reused-water-in-the-food-industry\/","title":{"rendered":"Decree No. 2024-33 on reused water in the food industry"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">On 25 January 2024, <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000049010414\">Decree No. 2024-33 of 24 January 2024 on reused water in food sector businesses and laying down various provisions relating to the sanitary safety of water intended for human consumption<\/a> was published in the JORF.<\/p>\n\n<p class=\"wp-block-paragraph\">This new decree defines the terms for authorising water unfit for consumption, recycled for the preparation and preservation of all foodstuffs and goods intended for human consumption.<\/p>\n\n<p class=\"wp-block-paragraph\">The text sets out the conditions required for the production and use of reused water for the preparation and preservation of all foodstuffs and goods intended for human consumption, including within the production environment. It specifies in particular the categories of possible uses, the authorisation procedure for reclaimed treated wastewater production projects (the content of the prefectural authorisation order) and the monitoring arrangements to be put in place to ensure that the production and use of reused water are compatible with food safety requirements.<\/p>\n\n<p class=\"wp-block-paragraph\">Under Art. R. 1322-77 of the French Public Health Code, food business operators may use recycled water from raw materials, recycled process water and reclaimed treated wastewater for the preparation, processing and preservation of all foodstuffs and goods intended for human consumption, including for cleaning premises, facilities and equipment, whether without contact or through direct or indirect contact with primary products, food in the course of preparation or finished foodstuffs.<\/p>\n\n<p class=\"wp-block-paragraph\">However, this water cannot be used as an ingredient in the composition of finished foodstuffs.<\/p>\n\n<p class=\"wp-block-paragraph\">The following cannot be used:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Wastewater from washing premises and instruments that may have been in contact with specified risk materials as defined by Regulation (EC) No 999\/2001 laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies.<\/li>\n\n\n\n<li>Wastewater from a treatment facility connected to an establishment for the collection, storage, handling after collection or processing of category 1 or 2 animal by-products, within the meaning of Regulation (EC) No 1069\/2009, or directly from that establishment.<\/li>\n\n\n\n<li>Wastewater from a wastewater treatment plant whose sludge does not meet the quality requirements for spreading on agricultural land set out in the order made under Article R. 211-43 of the French Environmental Code.<\/li>\n\n\n\n<li>Water with a chemical agent concentration sufficient to cause acute toxicity through contact or ingestion.<\/li>\n\n\n\n<li>Brines and concentrates produced by water treatment systems.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The establishment producing reclaimed treated wastewater and the establishment using this water must monitor its quality and regularly check that the production and use facilities for reclaimed treated wastewater are functioning properly, by means of a testing and analysis programme carried out at monitoring points determined according to the identified hazards.<\/p>\n\n<p class=\"wp-block-paragraph\">This decree is directly applicable.<\/p>\n\n<p class=\"wp-block-paragraph\">Phytocontrol holds national approval from the Ministry of Health and the Environment to carry out sampling and analyses for the sanitary control of water.<\/p>\n\n<p class=\"wp-block-paragraph\">You will find details of our accreditations in <a href=\"https:\/\/dev.phytocontrol.com\/en\/about-us\/our-accreditations-2\/\">our COFRAC technical annex No. 1-6066.<\/a><\/p>\n\n<p class=\"wp-block-paragraph\">Need technical, regulatory or pricing information?
