It aims to present the regulations relating to pesticide residues on and in foodstuffs.<\/p>\n\n<p class=\"wp-block-paragraph\">This instruction reflects the concepts set out in the various texts governing pesticide regulation: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Regulation 178\/2002 on the general principles of food law. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Directive 2002\/63\/EC on sampling for pesticide analysis. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Regulation EC 396\/2005 setting MRLs for pesticides in food and feed of plant and animal origin. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Regulation EC 1107\/2009 concerning the placing on the market of plant protection products. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Regulation EU 609\/2013, directive 2006\/141\/EC and delegated regulation EU 2016\/127 on infant food. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Technical instruction DGAL\/MUS\/2023-11 = Alert management guide <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">A flowchart is provided in Appendix III to help decide on the compliance of the foodstuff and its hazard level: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Presence of a residue authorised for the crop in France or approved in the EU \u2264 MRL: the batch is considered <strong>COMPLIANT<\/strong>. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Presence of a residue not authorised for the crop in France or not approved in the EU \u2264 MRL: the batch is considered <strong>COMPLIANT<\/strong>. <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The EU status of the substance or its use on a given crop in a given country is not taken into account when assessing the compliance of the sample. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Presence of a residue \u2264 MRL taking into account 50% measurement uncertainty: the batch is considered <strong>COMPLIANT<\/strong>. <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Presence of a residue \u2265 MRL taking into account 50% measurement uncertainty, with exposure below 100% of the ARfD: the batch is considered <strong>NON-COMPLIANT<\/strong> and presents <strong>NO RISK<\/strong> to health.  <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If the batch is placed on the market, it must be withdrawn. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Presence of a residue \u2265 MRL taking into account 50% measurement uncertainty, with exposure above 100% of the ARfD: the batch is considered <strong>NON-COMPLIANT and a RISK to health.<\/strong> <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If the batch is placed on the market, it must be both withdrawn AND recalled. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Raw analytical result \u2265 MRL without taking measurement uncertainty into account (CMR-1 substance or exposure above 100% of the ARfD): the batch is considered <strong>NON-COMPLIANT<\/strong> <strong>and a RISK to health.  <\/strong> <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If the batch is placed on the market, it must be both withdrawn AND recalled. <\/p>\n\n<p class=\"wp-block-paragraph\">As a reminder, here are the national rules established by the DGAL for applying the 50% uncertainty: <\/p>\n\n<p class=\"wp-block-paragraph\">I\/ If the pesticide is classified CMR-1: no uncertainty is applied. <\/p>\n\n<p class=\"wp-block-paragraph\">II\/   1-    If the pesticide has no set ARfD: no uncertainty is applied. <\/p>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>If the pesticide has an ARfD marked &#8220;not applicable&#8221;: the 50% uncertainty can be applied. <\/li>\n<\/ol>\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>If the pesticide is not CMR-1 and has an ARfD, an ARfD appendix must be carried out (to assess the toxicological risk) to determine whether the measurement uncertainty can be applied: <\/li>\n<\/ol>\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>If there is a toxicological risk: no uncertainty is applied. <\/li>\n<\/ol>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>If there is no toxicological risk: the 50% uncertainty can be applied. <\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Your Phytocontrol laboratory supports you in interpreting the compliance of your samples.
