{"id":32924,"date":"2024-07-03T17:12:19","date_gmt":"2024-07-03T15:12:19","guid":{"rendered":"https:\/\/www.phytocontrol.com\/?p=32924"},"modified":"2026-08-27T23:57:08","modified_gmt":"2026-08-27T21:57:08","slug":"2-new-amendments-to-eu-regulation-2023-915","status":"publish","type":"post","link":"https:\/\/dev.phytocontrol.com\/en\/regulatory-watch\/2-new-amendments-to-eu-regulation-2023-915\/","title":{"rendered":"2 new amendments to EU regulation 2023\/915"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">New texts amending EU regulation 2023\/915 have just been published in the OJEU.<\/p>\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A32024R1756&amp;qid=1720011209673\"><strong>Regulation EU 2024\/1756<\/strong><\/a>:<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This regulation provides clarifications on certain points of Annex I:<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>T2-HT2<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Point 1.9.5 concerning bakery products containing at least 90% oat milling products has been replaced by: Bakery products containing at least 75% oat milling products.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 100 \u00b5g\/kg applicable from 01\/07\/24 remains unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>HYDROCYANIC ACID<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Point 2.3.2 concerning unprocessed whole, ground, milled, cracked or crushed linseed placed on the market for the final consumer has been replaced by: Whole, ground, milled, cracked or crushed linseed placed on the market for the final consumer.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The applicable limit of 150 mg\/kg remains unchanged.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The wording of the exception in point 2.3.1 has been aligned with the wording concerning maximum levels of aflatoxins for peanuts (groundnuts) and other oilseeds intended for crushing for the production of refined vegetable oil.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 250 mg\/kg remains unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>OTA<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>A clarification has been added to the remark in point 1.2.9 concerning oat grains: The maximum level applies to unprocessed cereal grains (with husk, in the case of oats) placed on the market for first-stage processing.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 5 \u00b5g\/kg remains unchanged.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Point 1.2.10 concerning products derived from unprocessed cereal grains and raw cereals placed on the market for the final consumer, excluding products listed in points 1.2.11, 1.2.12, 1.2.13, 1.2.23 and 1.2.24, has been renamed for clarity as: Cereals placed on the market for the final consumer, Products derived from unprocessed cereal grains, excluding products listed in points 1.2.11, 1.2.12, 1.2.13, 1.2.23 and 1.2.24. Indeed, the term &#8220;placed on the market for the final consumer&#8221; refers to cereals and not to products derived from unprocessed cereal grains.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 3 \u00b5g\/kg remains unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>ZEA<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>Point 1.5.3 concerning cereals placed on the market for the final consumer, cereal flour, semolina, bran and germ as a finished product placed on the market for the final consumer, excluding products listed in points 1.5.5, 1.5.6 and 1.5.8, has been renamed as: Cereals, bran and germ placed on the market for the final consumer, Cereal flour and semolina, Excluding products listed in points 1.5.5, 1.5.6 and 1.5.8. Indeed, the terms &#8220;placed on the market for the final consumer&#8221; refer to the terms &#8220;cereals, bran and germ&#8221;, and not to the terms &#8220;cereal flour and semolina&#8221;.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 75 \u00b5g\/kg remains unchanged.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>A clarification has been added to the remark in point 1.5.1 concerning oat grains: The maximum level applies to unprocessed cereal grains (with husk, in the case of oats) placed on the market for first-stage processing.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limit of 100 \u00b5g\/kg remains unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>DIOXINS<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>The wording of the remarks in points 4.1.1, 4.1.11 and 4.1.12 has been rephrased.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limits remain unchanged.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>In point 4.1.1.8, the term &#8220;venison&#8221; has been replaced by &#8220;of cervids&#8221;.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limits remain unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>PAH<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>A distinction between products placed on the market in powder form and products placed on the market in liquid form has been added to points 5.1.13 and 5.1.15 concerning BBF foodstuffs.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The limits remain unchanged.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>NOTES<\/u>:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">In note (6) concerning the definition of first-stage processing, <strong>dehulling<\/strong> has been added as not being part of first-stage processing. Indeed, dehulling, the operation by which a grain is removed from its husk, is considered part of the cleaning process.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong><u>REMARKS<\/u>:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li>References to regulation 401\/2006 have been removed. Specific rules for sampling and analysis are now established for ergot sclerotia in regulation 2023\/2782 and for tropane alkaloids in regulation 2023\/2783.<\/li>\n\n\n\n<li>The wording concerning &#8220;unprocessed cereals placed on the market just before undergoing first-stage processing&#8221; has been replaced by &#8220;unprocessed cereals placed on the market for first-stage processing&#8221; in points 1.8.1 (ergot sclerotia), 1.2.9 (OTA), 1.5.1, 1.5.2 (ZEA), 1.6.1 (FUMO), 2.2.2, 2.2.3, 2.2.4 (tropane alkaloids).<\/li>\n\n\n\n<li>In points 1.4.7, 1.4.9, 1.4.10 (DON), 1.9.4, 1.9.9, 1.9.10 (T2-HT2), 1.5.4, 1.5.8 (ZEA), the scope of the exclusion of rice-based products has been clarified as follows: Excluding rice-based products (products whose only cereal ingredients are rice or products derived from rice).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The regulation is applicable from <strong>16\/07\/2024<\/strong>.<\/p>\n<p><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A32024R1808&amp;qid=1720011171207\">Regulation EU 2024\/1808<\/a><\/strong>: Ergot alkaloids<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">This regulation amends the application dates of the maximum levels for ergot alkaloids in certain foodstuffs:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>In point 1.8.2.1 for milling products of barley, spelt and oats (with an ash content of less than 900 mg\/100 g dry matter): the limit of 50 \u00b5g\/kg remains applicable from <strong>01\/07\/2024<\/strong>.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>In point 1.8.2.1 b-bis, for wheat milling products (with an ash content of less than 900 mg\/100 g dry matter): the limit of 50 \u00b5g\/kg will be applicable from <strong>01\/07\/2028<\/strong>. Until 30\/06\/2028, the limit of 100 \u00b5g\/kg applies.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>In point 1.8.2.3, for rye milling products and rye placed on the market for the final consumer: the limit of 250 \u00b5g\/kg will be applicable from <strong>01\/07\/2028<\/strong>. Until 30\/06\/2028, the limit of 500 \u00b5g\/kg applies.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Foodstuffs lawfully placed on the market before the dates mentioned above may remain on the market until their minimum durability date or use-by date.<\/p>\n\n<p class=\"wp-block-paragraph\">The regulation is applicable from <strong>22\/07\/2024<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Your Phytocontrol laboratory offers the analysis of these contaminants under COFRAC accreditation; you can consult our COFRAC technical annex No. 1-1904, available in your customer area or on the COFRAC website.<\/p>\n\n<p class=\"wp-block-paragraph\">Need technical, regulatory or pricing information?
